In a significant legal move, a cannabis business in Middlebury has filed a lawsuit against Vermont's Cannabis Control Board (CCB) over restrictions related to advertising and free speech. Dave Silberman, co-founder of FLŌRA, expressed frustration over the requirement that any promotional signage within their store must receive prior approval from the CCB. He stated, “If I want to put signage in my own store — 20% off a product — I need to get it pre-approved by the CCB.”
The lawsuit highlights concerns about the limitations placed on cannabis businesses in Vermont, particularly regarding their ability to communicate promotions and engage with customers. Silberman argues that these regulations infringe upon their rights to free speech and hinder their ability to operate competitively in the market.
As the cannabis industry continues to evolve in Vermont, this case could set a precedent for how cannabis businesses are allowed to market themselves, potentially impacting future regulations and the overall landscape of cannabis commerce in the state.
