A Texas Business Court judge has thrown out antitrust claims filed by Clean Hydrogen Works against ExxonMobil's Denbury subsidiary. The ruling states that Texas courts do not have the authority to address alleged antitrust injuries that occurred outside the state's borders.
Clean Hydrogen Works had accused Exxon of using its control over Denbury's 620-mile carbon dioxide pipeline network to block a planned $7.5 billion clean-fuels project in Louisiana. The company argued that Exxon was leveraging its dominance in the pipeline system to stifle competition and prevent the project from moving forward.
The judge's decision effectively ends the case in Texas, though it does not address the merits of the underlying allegations. Legal experts note that the ruling could force Clean Hydrogen Works to refile in a different jurisdiction if it wants to continue pursuing the claims.
The case highlights ongoing tensions in the emerging clean energy sector, where infrastructure control can be as valuable as the technology itself. ExxonMobil has not commented publicly on the ruling, but the company has consistently maintained that its business practices are lawful and competitive.
