New York Strengthens Consumer Protection with New Business Practices Law

On December 19, New York Governor Kathy Hochul signed into law S8416, which amends the state’s General Business Law to enhance consumer protection measures. This legislation, known as the Fostering Affordability and Inclusion in Retail (FAIR) Business Practices Act, aims to create a fairer marketplace for consumers by addressing various business practices that may exploit or mislead them.

The new law introduces several key provisions designed to protect consumers from deceptive advertising, unfair pricing strategies, and other unethical practices. Businesses will now be required to provide clearer information regarding pricing and terms of service, ensuring that consumers can make informed decisions. Additionally, the legislation empowers consumers to hold companies accountable for violations, promoting transparency and ethical conduct in the retail sector.

Governor Hochul emphasized the importance of safeguarding consumer rights, stating that this law will foster a more equitable economic environment. The FAIR Business Practices Act marks a significant step forward in New York's ongoing efforts to enhance consumer protection and promote fair business practices across the state.
